Waiver and General Release and Covenant Not to Sue
IMPORTANT: THIS DOCUMENT CONTAINS A WAIVER AND RELEASE OF POTENTIAL LEGAL CLAIMS FOR PERSONAL INJURY AND/OR PROPERTY DAMAGE. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING.
In consideration of being permitted to enter the Premises and participate in Beyond the Diamond and related activities (“Event”) at the Aon Grand Ballroom at Navy Pier, having an address at 600 East Grand Avenue, Chicago, IL 60611 (“Premises”), I hereby agree to the following:
1. Assumption of Risk. I acknowledge that entering the Premises involves the risk of personal injury and the possible exposure to and illness from infectious diseases (such as MRSA, influenza and COVID-19). I shall adhere to all safety guidelines set by the Released Parties.
2. Release of Liability. Understanding that risk and in consideration of being allowed on the Premises, I, on my own behalf and on behalf of my heirs, administrators, executors, and assigns, hereby (i) fully release and discharge the MLB Entities (defined below), Chicago White Sox Ltd., Chisox Corporation, Chicago White Sox Charities, and all of their respective officers, agents, employees, shareholders, and partners and representatives, and any and all of their respective subsidiaries or affiliates (collectively, the “Released Parties”), from any and all claims, demands, personal injuries (including death), liabilities, or causes of action of whatsoever kind or nature, in longevity or otherwise, which hereinafter may accrue against them and which in any way arise while on the Premises, regardless of whether based on fault or negligence of the Released Parties, (ii) covenant not to sue any of the Released Parties for any matter relating to my participation in activities on the Premises, and (iii) indemnify, defend, and hold the Released Parties harmless from and against any and all losses, damages, costs or expenses (including attorneys' fees and other costs of defense) which any of them may sustain as a result of, or in connection with, my activities while on the Premises.
3. MLB Entities. As used herein, the "MLB Entities" shall mean MLB Advanced Media, L.P., the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs ("Clubs"), Major League Baseball Properties, Inc., Tickets.com, LLC, The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.
4. Image Release. I hereby grant full permission to the Released Parties (and their respective licensees, sponsors and designees), or any one of them, to exhibit, record, reproduce, broadcast, transmit, publish, sell, distribute, perform, use and re-use, and to license others to exhibit, record, reproduce, broadcast, transmit, publish, sell, distribute, perform, use and re-use, for any purpose, in any manner, without further notification, authorization or compensation to me or anyone on my behalf, my name and likeness (or that of any minor), and any photographs, videotapes, motion pictures, recordings, or other record of my participation in the Event, in any and all media, whether now known or hereafter developed, worldwide and in perpetuity.
